A memorial service will be held Tuesday for prominent defense attorney Phillip McKay Sutley, who once convinced jurors to spare the life of a nuns killer. Sutley, 66, passed away suddenly Thursday in the Clarence M. Mitchell Jr. Courthouse in Baltimore. It is believed that his death may have been caused by a heart condition. Born in Baltimore, Sutley graduated from the Johns Hopkins University in 1962. He served in the Army before attending the University of Baltimore School of Law, from which he received his degree in 1967.
New York States criminal indigent defense system is broken and must be reformed in order to ensure justice for the poor. This was the message attorneys from throughout Western New York shared with the New York State Commission on the Future of Indigent Defense Services on Friday, March 11. The commission held a day long public hearing in Rochester to solicit comments and ideas on how to improve the criminal indigent defense system. Some of the attorneys appearing before the commission called for the creation of a statewide public defenders office. Attorneys called for a set of uniform standards and procedures for public defenders and anyone else who represents the indigent.

Strawbridge and colleagues (4) conducted a 28-year prospective assessment of more than 5,000 adults. They found that weekly attendance of religious services decreased the relative risk (RR) of dying during follow-up by 36 percent (RR, 0.64; 95% confidence interval [CI], 0.53 to 0.77); adjusting for social connections and health practices reduced the effect to 23 percent (RR, 0.77; 95% CI, 0.64 to 0.93). The effect in women (RR, 0.66; 95% CI, 0.51 to 0.86, adjusted for covariates) approximated the effect of not smoking cigarettes. (5) Frequent attendance was a predictor of better health behaviors, improved mental health, and increased social connections. (6) these findings were replicated in a sample of 4,000 older adults followed for six years. (7) The effect was similar (RR, 0.72; 95% CI, 0.64 to 0.81, adjusted) and was strongest in women (RR, 0.65; 95% CI, 0.55 to 0.76, adjusted). A random survey8 of more than 20,000 Americans found that whites who attended religious services regularly lived an average of seven years longer than those who did not, and blacks who attended regularly lived an average of 14 years longer than those who did not. After controlling for multiple covariates and explanatory factors, the risk of dying during the eight-year follow-up was 50 percent higher in persons who never attended religious services than for those who attend more than once per week. Most recently, Lutgendorf and colleagues (9) prospectively examined religious attendance and interleukin-6 (IL-6) levels as they relate to mortality rates in 557 older adults. After controlling for multiple covariates and explanatory factors, frequent attendance of religious services reduced the risk of dying in the six-year follow-up period by 78 percent (odds ratio [Or], 0.32; 95% CI, 0.15 to 0.72) compared with nonattendance; this finding seemed to be mediated by decreased serum IL-6 levels (Or, 0.34; 95% CI, 0.16 to 0.73), which replicated earlier findings. (10) High IL-6 levels are an indicator of immune system dysfunction and thus provide a possible biologic mechanism by which religious attendance may influence physical health.
The applicant pool included investigators from just about every major research university in the United States. The STP offered a round of grants to investigators researching this phenomenon, as well as put together a conference on the scientific research of spiritual transformation. The Request for Proposals targeted a diverse array of academic fields and the awardees reflect that diversity. The STP is funding anthropologists, neuroscientists, physicians, psychologists, religionists, and sociologists to conduct research on this phenomenon, looking at the various pathways, contexts, and outcomes of spiritual transformation experiences. The projects range from neuroscientific research on Carmelite Nuns to an ethnography on children in Buddhist monasteries to the transformation experiences of AIDS patients to a national survey of spiritual transformation experiences. In order to support such a wide-ranging social scientific and natural scientific research initiative, it was necessary for the STP to provide a working definition of spiritual transformation for each of these prospective investigators. William James also offered a provisional hypothesis on religion for his investigation of religious experience in the Varieties. How does the concept of religion for James relate to the STPs notion of spiritual transformation? This paper will offer a close reading of the Varieties to discuss the development of Jamess conception of religion and religious experience within the text and then discuss the character of the STPs working defnition of spiritual transformation, unveiling some of the conceptual tensions at stake in conducting natural and social scientific research on religious phenomena.
Many people use the related terms religion and spirituality almost interchangeably. I would like to take a look at this set of ideas through the eyes of the Unitarian ministers and philosophers who influenced the Unitarian denomination, and wrote and signed the Humanist Manifesto of 1933. In reading this first Humanist Manifesto, I discovered that within the brief introduction religion or religious is used thirteen times. Also, among the fifteen principles in the manifesto, I found ten that made specific references to religion. That totals twenty-three such references in a four-page document. What did the generation of manifesto signers, committed to naturalistic humanism, have in mind, and how did they define religion? A majority of the signers were Unitarian ministers and few were tenured university professors like Roy Wood Sellars. This fact is apparently significant for both the development of humanism within the Unitarian denomination and for humanism as a philosophical movement. The six leading humanists of the time who had the most impact on the manifesto were John Dietrich and Curtis W. Reese, who were the main force in promoting humanism among the Unitarians; Charles Francis Potter, who established the First Humanist Society of New York as an independent humanist church; Raymond B. Bragg and Edwin H. Wilson, two Unitarian ministers who were instrumental in initiating the manifesto and seeing it through the several steps of writing, revision, signing, printing and distribution; and Roy Wood Sellars, who wrote the first draft of the manifesto.

In therapeutic interviews described as either hypnosis or biofeedback, the patient must change mental imagery to achieve the desired state or physiologic change. Hypnosis is widely used and accepted as an adjunct to treatment for pain control, habit disorders, symptom reduction, and many medical problems. Although in the past the application and effectiveness of hypnosis have been questioned by the medical community, the clinical disciplines that use hypnotherapy have grown to include the medical specialties, psychiatry, psychology, and social work. In the last 20 years over 100 review articles have been published by a diverse membership in both the American Journal of Clinical Hypnosis and the Journal of Clinical and Experimental Hypnosis, which are the respective journals of the American Society of Clinical Hypnosis and the Society of Clinical and Experimental Hypnosis. The International Society of Hypnosis is composed of individual members from more than 20 national constituent societies. The use of hypnosis is widespread in various areas of clinical medicine, and family physicians are in an ideal position to address questions about the indications, misconceptions, and contraindications for the use of hypnosis. The physicians understanding of the history, theory, and clinical application can help guide the patient to this alternate therapeutic modality. Simply put, the intention of this legal reform is to simplify the law and to improve accessibility for all by streamlining procedures in response to the public. Alberta Justice, through its Family Law Reform Project, initiated a review of all provincial family laws following a series of public consultations, primarily in Edmonton and Calgary. Family law problems are inherently complicated and in Alberta, in addition to legal issues, procedural issues–both systemic and jurisdictional–have long frustrated efforts to resolve cases. Some family law problems, such as divorce, spousal support, and child support, are matters of federal jurisdiction, governed by the laws of Canada. Others, such as the division of matrimonial property and custody or access orders in non-divorce or common-law situations, are said to be matters of local and provincial concern and are governed by provincial laws. While legislative jurisdiction is a topic that does not really interest anyone other than lawyers, it is something that, in Alberta at least, has confused and frustrated members of the public, since it determines which court deals with which issues. As a rule, matters arising from federal statutes must be dealt with in courts of superior jurisdiction–in Alberta, this is the Court of Queens Bench–while matters arising from provincial legislation are generally, but not exclusively, matters for the lower level provincial courts. For years, the public has had difficulty determining which court is the appropriate court for a particular problem. In addition, there has been significant concern in the past over jurisdictional abuses, including forum shopping and the unnecessary duplication of proceedings in both levels of court. Sometimes this occurs at the initiative of lawyers themselves, but it is also common on the express instruction of clients. Clients unhappy with a lower court decision may want a second kick at the can in the higher level court. Applying for the same or similar relief in a higher level court is a de facto appeal of the lower level decision, without meeting the formal requirements for an appeal in law. While members of the Alberta judiciary frown on it, whether at the behest of lawyers or clients, such conduct has been frustrating to contend with over the years.

When they talk about appraisal under the terms of a property policy, textbooks, instructional materials and, instructors have, always had a tendency to presume that the parties have resolved all coverage issues before they resort to appraisal. Thats probably the effect of common sense lurking in the subconscious and exerting a powerful influence over what gets written or spoken. An appraisal is an expensive proposition and each party has to bear a share of the cost. Because the appraiser cant consider coverage issues, the thing to do is resolve them before incurring the expense of an appraisal. Thats just common sense.

Two adjoining houses in Fitzjohns Avenue were replanned and redesigned with specially selected materials. This bears out evidence from builders such as Barratt of a new breed of buyer at the top end of the market who, frustrated by the lack of good property available, is turning to developers for the first time. The success of Barratts award-winning development, Lakeside Grange, in Weybridge, Surrey, looks like being matched by its latest enterprise on the River Thames at Chiswick. This study, performed in Bonn, Germany, evaluated the effect of four weeks of supplementation with folic acid (400 [micro] g/day), vitamin [B.sub.6], (2 mg/day), or both on homocysteine levels in 106 healthy young women. As compared to women receiving placebo, those receiving folic acid, with or without vitamin [B.sub.6], showed a significant reduction in plasma homocysteine levels (17% in the group receiving both vitamins, 11.5% in the group receiving folic acid alone, with no significant difference between these two groups). Vitamin [B.sub.6], administered alone, had no significant effect on homocysteine levels. The results of this study indicate that supplementation with physiologic doses of folic acid can reduce homocysteine levels within the normal range. Since even moderate elevations in homocysteine concentrations are a risk factor for cardiovascular disease, the reduction in homocysteine produced by supplementation might have long-term health benefits. Additional studies are needed to determine whether similar effects on homocysteine can be produced with dietary folate rather than folic acid supplements. This report describes six cases of hypovitaminosis D in women who had immigrated to The Netherlands from Morocco (two cases), Pakistan (two cases), Surinam, or Turkey. In all six cases, there was a long delay (7 to 103 months) between the onset of symptoms and the correct diagnosis. All of the women were subjected to multiple diagnostic tests, X-rays, and treatment with non-steroidal anti-inflammatory drugs and other medicines, four underwent extensive physiotherapy, and one with stomach pains underwent unnecessary surgery because her symptoms were believed to be due to gallbladder disease.The authors conclude that hypovitaminosis D osteopathy in women who have immigrated to Western Europe may remain undiagnosed for an unacceptably long time. Although Tanzanias standard of care recommends that children receive a dose of vitamin A every six months, trial results showed that maternal vitamin A supplementation increased HIV transmission to children. The studys data and safety monitoring board recommended that vitamin A be discontinued from the trial regimen in September 2000. The researchers note in their article, Among HIV-infected US men, the relationship between vitamin A intake and HIV disease progression and mortality was U-shaped, suggesting that both low and high levels of intake are potentially harmful. The group that received multivitamins had higher CD4+ levels and significantly lower viral loads than those on placebo. (Vitamin A combined with the multivitamin was less effective.) Women taking the multivitamin had less fatigue, fewer acute upper respiratory tract infections, fewer rashes, and fewer oral and gastrointestinal problems associated with HIV/AIDS. These women were also less likely to reach WHO stage 4 or die of AIDS-related illness than those taking a placebo. I wonder if the inclusion of minerals known to support the immune system (i.e., selenium, zinc) in the multivitamin formula would increase this benefit. Fourteen years after its release, My Cousin Vinny retains a devoted audience in the criminal defense legal community. This spring, two presenters at a National Association of Criminal Defense Lawyers conference used clips from the movie to teach young lawyers the finer points of voir dire, cross-examination and trial strategy. Several other criminal defense lawyers told Lawyers USA they routinely cite scenes from the movie to illustrate key legal points - both with other attorneys and their clients. Most movies dont really get into trial procedure, but My Cousin Vinny does, Miller said. Movies are great because they dramatize and bring a reality - even when fictional or funny - to law in action in a way that the classroom does not. Even a sensationalized scene like the Cruise-Nicholson confrontation in A Few Good Men, tells the student that courtroom drama plays out in real life, although admittedly rarely in the stark form that Hollywood offers.
THE SOCIETY of Black Lawyers yesterday demanded the setting up of a new race-hate register so that racist criminals could be more closely monitored by the police. Peter Herbert, the societys chairman, said research had shown that racist attacks were rarely spur of the moment incidents and were often carried out by perpetrators from identifiable problem estates or families. He said because there were identifiable patterns, resources could be targeted. The society wants to see the subject of racism introduced into the national curriculum for primary schools. Mr Herbert said this month had been dedicated “Black History Month” yet only a handful of schools were taking part in the exercise. The Society of Black Lawyers is organising the first international conference on race-hate crimes, to be held in London in December. The high-profile black American lawyer Johnnie Cochran and the United States deputy attorney general, Eric Holder, will attend along with Stephen Lawrences parents and their lawyers. Mr Herbert said the evidence of bad practice which has emerged at the Lawrence inquiry had been received with dismay in the US, where Scotland Yard has legendary status. “The British police and Scotland Yard have a reputation for dogged thoroughness and it is something that has tarnished their international reputation,” he said. The other groups giving evidence yesterday, the last day of this phase of the inquiry, were the Justices Clerks Society and the anti- racist 1990 Trust. Today, the inquiry team begins a tour of the regions before retiring to produce its report, expected early in the new year.

Fiftyish parents are not the only ones anxious to see the children move out and get on with their lives. Realtors also look forward to the empty-nest stage so they can sell vacation homes to affluent couples with money to spend on themselves. But some parents dont wait for the nest to empty before they buy another one. Couples with children under age 18 at home have an average propensity to own vacation homes. But they are numerous, so they comprise 25 percent of the total market. Single parents, people who live alone, and other households are about half as likely as average to have second homes, but this diverse group is numerous enough that it also accounts for 27 percent of the market. Real estate accumulates with age. Few house-holders under age 35 own a second home. The two largest age markets are couples aged 35 to 54 with children under age 18 at home and couples aged 55 and older with no children. Each comprises about 20 percent of the total.
Vacation- and investment-home sales both set records in 2005, with the combined total of second home sales accounting for four out of 10 residential transactions, according to the National Association of Realtors[R]. David Lereah, NARs chief economist, said the baby boom generation is driving second home sales. Theyre at the optimum point in life when people become interested in second homes, theyre at the peak of their earnings.

The Methodist church has set up a company to manage an ethically correct portfolio. It joins the Co-operative Bank and a small, but growing number of organisations that believe they can influence the way corporate Britain behaves by withholding their money from companies involved in alcohol, tobacco, armaments, gambling and pornography. They call it “ethical” investing. Say you are buying stock in Hanson, one of the biggest cigarette manufacturers in the country (it owns what used to be called Imperial Tobacco, maker of Players and Embassy). Its stock market value is about pounds 10bn. To have any significant effect on the company, you would have to pick up at least half a per cent of the company - that would cost you pounds 50m. The Methodists may well have access to funds on this scale. Presumably, they wont be buying Hanson shares. But would it not be making a stronger ethical statement if it did buy a slug of Hanson and started fighting from within? The Methodists would be one of the dozen biggest shareholders, and Hanson, famous for working “in its shareholders interests”, would have to sit up and listen to them rather than dismissing them as a bunch of ignorant do-gooders.

Monday May 5, 2003 will go down in history as a day to remember in employment law. It was the day the long-debated amendments to the Health Safety in Employment Act finally came into effect. Why is this new legislation so important? The term “workplace stress” took on a whole new significance, with new obligations for employers, and potentially serious financial consequences for those who ignore them. Workplace stress is no longer simply a sad fact of life. It is now an officially recognised and legislated “workplace hazard”, with the amendments extending the definitions of “harm” and “hazard” to include physical and mental harm caused by work-related stress. A cursory reading of the new legislation might be enough to instantly treble employers workplace stress, but a deeper understanding goes some way to restoring mental equilibrium. The Occupational Safety and Health booklet, Healthy work, Managing Stress in the Workplace, tells employers that “there is only a requirement to manage work stressors or the individuals stressed situation where you can be reasonably expected to know about the stress. Even then the obligation is only to do what is reasonably practicable in the circumstances.”

The marketing mix, on the other hand, includes the main decision areas that an entrepreneur must consider on an ongoing basis. Some elements of the market environment, such as the general economic conditions, are beyond a small business owners control. A CDC investigator has linked an outbreak of skin infections to unsanitary practices at a body-wrap salon. The spa, as others do, has customers exercise while tightly swathed in wet elastic bandages. At the salon, Cronquist and her health-department colleagues found P. aeruginosa on bandages and in unrefrigerated bottles of the solution for soaking bandages. To reduce the likelihood of outbreaks, Cronquist recommends that wrap salons use bandages only once or launder them in hot water and soap. The salons contract with its franchiser stipulates that it reuse bandages after washing them in cold water and grapefruit-seed extract.

AUTOMATIONThere are many different reasons to automate. Increased productivity is normally the major reason for many companies desiring a competitive advantage. Automation also offers low operational variability. Variability is directly related to quality and productivity. Other reasons to automate include the presence of a hazardous working environment and the high cost of human labor. Some businesses automate processes in order to reduce production time, increase manufacturing flexibility, reduce costs, eliminate human error, or make up for a labor shortage. Decisions associated with automation are usually concerned with some or all of these economic and social considerations.For small business owners, weighing the pros and cons of automation can be a daunting task. But consultants contend that it is an issue that should not be put off. We are creating a new ball game, wrote Perry Pascarella in Industry Week. Call it a learning tool, a babysitter or both–the latest crop of childrens arts and crafts products deliver just what moms and dads like to see kids doing around the house–having good, clean fun while also learning skills. Walgreens reported showing substantial growth in this segment in 1998. Other drug chains, such as CVS and Longs, have also cited childrens arts and crafts as a growth segment in stationery, complementing other emerging family craft areas, such as scrapbooking and the home creation of greeting cards, newsletters and other graphic output, largely on the family computer. Results of a leisure-time consumer study, conducted by Binney Smith, showed that 29 percent of purchases of childrens art product are for back-to-school, and 11 percent are holiday and last-minute impulse and stocking-stuffer purchases, but that everyday purchases account for 60 percent of this segments sales in the drug channel.

New withholding requirements recently enacted by the state affect all individuals who sell California real property. Beginning Jan. 1, escrow companies must withhold 3-1/3 percent of the sales price of any real estate sold that is more than $100,000, not a personal residence, and not a 1031 exchange, 1033 involuntary conversion or a foreclosure. The only exception to the withholding requirement is if the seller signs under penalty of perjury that there is a loss on the sale.
Among the transactions funded on behalf of Corporate Properties Associates 15 Incorporated, part of the $6 billion W. P. Carey Group of income generating, publicly held, non-traded real estate investment trusts, were: The acquisition of a Belgian government office facility in Mons, Belgium, for 11.5 [euro] million ($14.7 million U.S.). The 90,000 s/f property will be leased for a period of 18 years. This is the first time the W. P. Carey Group has purchased a property in Belgium and it adds to its growing portfolio of properties in Europe. The $12.5 million acquisition of the corporate headquarters (two buildings) and primary call center from a leading business services company offering outsourced customer services and customer relationship management programs to Fortune 1000 firms. The 111,000 s/f facilities, located in Peoria, Illinois, will be leased under a 20-year, triple-net lease with two, ten-year renewal options.
